Terms & Conditions

These Terms govern your use of Famielda Web, Famielda Mobile, and the family care workspace. Please read them with the Privacy Policy before you create an account.

Famielda coordinates care. It does not replace it. We are not a hospital, clinic, pharmacy, diagnostic service, or emergency line. If someone is in immediate danger, contact local emergency services.

1. The agreement

These Terms & Conditions (“Terms”) are a contract between you and Famielda for use of the website at famielda.web.app, the signed-in workspace, Famielda Mobile, and related features (together, the “Service”).

By creating an account, clicking to accept, or using the Service, you agree to these Terms and to the Privacy Policy. If you use Famielda on behalf of a household, practice, or employer, you represent that you have authority to bind that group — and “you” includes that group.

If you do not agree, do not use the Service.

2. The service

Famielda is a family care workspace: one senior profile, one care circle, one schedule, and one record, so families, caregivers, and health practitioners can stay aligned. Plans are described on Pricing. Features may differ between Free and Famielda Plus, and between web and mobile, but they share the same account.

Famielda is not:

  • a hospital, clinic, home-health agency, or public caregiver directory;
  • a pharmacy, laboratory, or system that diagnoses or prescribes;
  • insurance, a medical bill, or a charge for a home-care shift;
  • a substitute for licensed clinical judgment, power of attorney, or emergency services;
  • a medical device.

We may change, suspend, or discontinue features with reasonable notice when practical. We do not promise that the Service will be uninterrupted or error-free.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to create an account. You agree to provide accurate registration information (name, email, phone, and role) and to keep it current.

You are responsible for the password and for activity on your account. Notify us promptly if you believe the account is misused. We may require email verification before the workspace opens. The same email and password sign in on Famielda Web and Famielda Mobile. Password resets and account deletion apply to both.

Role setup runs once after registration. If you chose the wrong role, contact support; an administrator may update it. We may refuse, suspend, or reclaim accounts that violate these Terms or that we reasonably believe are automated, fraudulent, or unsafe.

4. Roles, senior profiles, and household authority

Family members coordinate the household. Caregivers provide daily support in the home. Health practitioners bring clinical judgment into the same workspace when invited. Administrators operate the platform.

When you create or edit a senior profile, you represent that you have a legitimate basis to do so — for example as a family member coordinating care, with the person’s permission, or under other lawful authority. You must not upload another person’s health, identity, or legal documents unless you are entitled to handle them.

The household that owns a workspace controls invitations and permissions. You are responsible for who you invite and for the accuracy of information you enter. Viewers, members, coordinators, and owners have different rights; do not share a login in place of an invitation.

5. Caregivers, practitioners, and verification

Professionals create a free account and join a household by invitation. They do not pay Famielda to accept an invitation. The household that runs the workspace pays for Plus when the circle needs professional access and related features.

Caregivers and practitioners may submit identity and license or credential documents. Famielda reviews them before a verified badge appears. Review is not hospital credentialing, not an employment decision, and not a warranty of skill, insurance, or fitness for a particular assignment. Families remain responsible for whom they invite into the home.

Licensed professionals must follow their license, employer, and applicable law. Famielda does not supervise clinical care and does not replace the professional’s own record-keeping duties.

6. Acceptable use

You agree not to:

  • break the law, infringe others’ rights, or upload content you do not have the right to share;
  • harass, exploit, or endanger anyone, including the person whose care is being coordinated;
  • attempt to access another household’s data, probe the Service, bypass role or plan limits, or interfere with security;
  • misrepresent your identity, credentials, or relationship to a senior or household;
  • use Famielda to send spam, scrape the Service, or operate an undisclosed competing service on top of it;
  • upload malware or content that is illegal, or that we reasonably consider abusive;
  • treat the Service as an emergency dispatch line or as the only place a critical clinical fact exists if your profession requires otherwise.

We may remove content, revoke invitations, or suspend accounts when we reasonably believe these rules were broken.

7. Health, safety, and emergencies

Information in Famielda is supplied by the circle for coordination. Famielda does not independently verify medications, diagnoses, or visit notes, and does not provide medical, legal, or financial advice. Resource articles on the public site are general information, not advice for a specific person.

If someone is in immediate danger, contact local emergency services. The Service may carry emergency status inside a signed-in circle; that is not a substitute for a 911 or equivalent call, and delivery of notifications is not guaranteed.

8. Plans, Plus, and billing

Famielda Free includes one senior profile, two family members, and basic coordination, as described on the pricing page. Famielda Plus is offered at the then-current prices (currently $9.99 per month or $99.99 per year) and unlocks a larger circle, medication tools, document vault, care history, advanced reports, and professional circle access, subject to the entitlements in the product.

Plus is paid by the household that runs the workspace, through Stripe, after you create an account and open Settings → Subscription. We do not store full card numbers. Prices, taxes, and invoice details appear at checkout and in the Stripe Customer Portal.

Subscriptions renew until cancelled. You may cancel anytime; Plus remains available through the end of the current period. We do not prorate cancellation refunds unless required by law or we agree otherwise in writing. If a payment fails, Plus may show as past due; update the card in Settings. We may downgrade or suspend Plus features if payment is not repaired.

Promo or referral benefits, if offered, are subject to the rules shown at the time of the invite and may be revoked for abuse. Professionals do not pay Famielda to join a circle.

Fees paid to Famielda are for software access. They are not insurance premiums, clinical fees, or wages for a caregiver visit.

9. Your content

You retain whatever rights you already have in the information and files you submit (“Content”), including senior profiles, notes, messages, and documents. You grant Famielda a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and otherwise process Content solely to operate, secure, and improve the Service, and as described in the Privacy Policy.

You represent that you have the rights needed to grant that license and that Content does not violate law or these Terms. Households are responsible for keeping their own copies of anything they cannot afford to lose. Deleting an account removes that login; it may not erase every record others in the circle still need.

10. Famielda’s rights

The Service — including the Famielda name, logo, layout, software, and original copy — is owned by Famielda and its licensors. These Terms do not sell the software. You receive a limited, revocable, non-transferable, non-exclusive right to use the Service for its intended care-coordination purpose, in line with your plan.

You may not copy, reverse engineer, or resell the Service except as allowed by law that cannot be waived. Feedback you send may be used to improve Famielda without obligation to you.

11. Third-party services

The Service depends on providers such as Google Firebase and Stripe. Their terms apply to the portions they operate (for example, card processing). Store listings for Famielda Mobile, when available, are also governed by the relevant app-store terms. We are not responsible for third-party sites we link to for convenience, including public resource pages off Famielda.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, FAMIELDA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that care data will be complete or that a visit, reminder, or notification will occur at a particular time. Families and professionals remain responsible for the care they give and the records their profession requires.

Some places do not allow certain disclaimers. In those places, the disclaimer applies to the maximum extent allowed.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FAMIELDA AND ITS OPERATORS, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, FAMIELDA’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO FAMIELDA FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50).

These limits do not apply to liability that cannot be limited under applicable law, such as liability for death or personal injury caused by negligence where that limitation is forbidden, or for fraud.

14. Indemnity

You will defend and indemnify Famielda and its operators against claims, damages, and reasonable legal fees arising from: (a) your Content or your use of the Service; (b) your invitations or the people you bring into a home or a circle; (c) your violation of these Terms or of law; or (d) a dispute among members of a household or between a household and a professional, except to the extent caused by Famielda’s willful misconduct.

15. Suspension and termination

You may stop using the Service and delete your account from Settings at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. We may also suspend accounts for security, non-payment of Plus, or operational abuse.

Provisions that by their nature should survive — including ownership, disclaimers, limits of liability, indemnity, and governing law — survive termination. After deletion or termination we may retain limited records as described in the Privacy Policy.

16. Changes, governing law, and disputes

We may update these Terms. The effective date at the top will change. Material changes may be announced in the product or by email. If you continue to use the Service after the update, you accept the new Terms. If you do not agree, stop using the Service and delete your account.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except that if you are a consumer living in a place that requires its own law to apply, that law applies to the extent it cannot be waived.

Before filing a claim, you agree to try to resolve the dispute informally by contacting us and allowing 30 days for a response. If we cannot resolve it, courts of competent jurisdiction may hear the dispute, except where applicable law requires another forum. You and Famielda both waive class actions to the extent that waiver is enforceable where you live.

If a provision is unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement for the Service. They supersede prior terms for the same subject. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale of the Service.
